General Service Terms
Effective September 3, 2026
These general terms describe the framework Elm City Property Services expects to use when providing property services. A written estimate, work order, proposal, or other project agreement may add to or replace portions of these terms for a particular job. Where there is a conflict, the project-specific written agreement controls.
Scope and authorization
Elm City will perform the work described in the accepted estimate, work order, or written authorization. Work outside the agreed scope may require additional authorization and may affect pricing or schedule.
Site access and conditions
Clients are responsible for providing reasonable access to the work area and identifying known hazards, restrictions, concealed conditions, or building rules that could affect the work. Unforeseen site conditions may require changes to the planned scope.
Scheduling
Scheduling is subject to workload, weather, material availability, access, and other conditions reasonably outside Elm City’s control. We will communicate material schedule changes when practical.
Materials and changes
Material selections and substitutions will be handled according to the applicable estimate or project communication. Client-requested changes may require revised pricing, materials, or timing.
Payment
Payment amounts, deposits, milestones, and due dates will be stated in the applicable estimate, invoice, or agreement. Clients should review those project-specific terms before authorizing work.
Workmanship and concerns
Elm City aims to complete work professionally and in accordance with the agreed scope. Clients should raise concerns promptly so they can be reviewed and addressed appropriately. Manufacturer products and materials may be subject to separate manufacturer warranties.
Existing conditions
Elm City is not responsible for pre-existing defects, concealed damage, code issues, hazardous materials, or conditions that could not reasonably be identified before work began, except to the extent responsibility is imposed by applicable law.
Legal rights
These terms do not remove consumer or statutory rights that cannot lawfully be waived. Project agreements are governed by applicable laws in New Brunswick and Canada.
